By accessing or using megakron.com, submitting a request, or purchasing a Megakron product through an identified sales channel, you agree to these terms and any additional written terms presented with a quote, invoice, order, or checkout.
1. Website Use
You may use this website for lawful personal or business purposes related to Megakron products, services, projects, and community activities. You may not interfere with site security or operation; attempt unauthorized access; submit unlawful, deceptive, infringing, or malicious content; scrape or copy the site at unreasonable scale; or use Megakron names, images, designs, or materials without permission.
2. Information and Availability
We work to keep website information accurate, but product details, colors, materials, compatibility, availability, pricing, and timelines may change. Website content is general information and is not a binding offer unless confirmed in writing by Megakron or through an authorized checkout.
3. Quotes, Fitment, and Custom Orders
A submitted form is a request for review—not an accepted order. A project becomes an order only after specifications, price, payment requirements, estimated timing, and any additional written terms are confirmed. Customers are responsible for providing accurate vehicle information, measurements, photos, shipping details, and approved specifications.
Custom materials, colors, stitching, pleating, window configurations, and made-to-order parts may vary slightly from screen images or samples. Vehicle modifications, prior repairs, installation methods, and measurement differences can affect fitment. Approval of final specifications authorizes production based on the information supplied.
4. Product and Purchase Policy
Custom and made-to-order ragtop purchases are governed by Megakron's separate Product Policy, including the final-sale rule, the limited replacement process for qualifying material-condition problems, and the five-calendar-day notification deadline. Terms presented by an independent seller at checkout may also apply to purchases made through Convertibletops.co or Legendz Fight Club.
5. Customer Content
If you submit vehicle photographs, testimonials, reviews, social links, or project information, you confirm that you have the right to provide them. You retain ownership of your content. Unless separately authorized, submission for a quote or support request does not grant public promotional use. If you expressly authorize publication, you grant Megakron a nonexclusive license to display and promote the submitted material in connection with Megakron.
6. Intellectual Property
The website’s branding, copy, graphics, layout, photographs, logos, and other content are owned by or licensed to Megakron and are protected by applicable intellectual-property laws. Product and company names belonging to others remain the property of their respective owners.
7. Marketing Communications
Where you provide the required consent, Megakron may send email or SMS marketing communications about products, projects, events, community stories, offers, and related updates. Message and data rates may apply to SMS communications. Consent is not a condition of purchasing a product or service.
You may opt out of marketing emails through an unsubscribe link in an email or by contacting unsub@megakron.com. You may opt out of SMS marketing by replying STOP where that option is available. Marketing opt-out requests do not prevent necessary messages about an active quote, order, or customer-service request.
8. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the website is provided “as is” and “as available.” Megakron disclaims implied warranties concerning the website except where they cannot legally be excluded. Megakron is not liable for indirect, incidental, special, consequential, or punitive damages arising from website use, third-party services, delays outside reasonable control, or reliance on general website information.
Nothing in these terms excludes rights or remedies that cannot be waived under applicable law. Product-specific warranties or remedies, if any, will be stated in the applicable written quote, invoice, checkout terms, or manufacturer documentation.
9. Third-Party Websites
Links to ecommerce, merchandise, social-media, event, payment, shipping, or other third-party services are provided for convenience. Megakron is not responsible for an independent third party’s content, availability, security, or practices.
10. Governing Law and Changes
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply. We may update these terms by posting a revised version and effective date. Changes apply prospectively after posting.
